The present General Terms of Service (hereinafter the “Conditions”) form the contract between TOODDOC S.R.L. and the User (practitioners and patients) concerning the use of the Website and the Application, available at https://tooddoc.com/en/terms-of-use
It is imperative to read these Conditions carefully. By accessing and using the Website and/or the Application, the User concedes to understand and unreservedly accept these Conditions. In the event of non-acceptance of these Conditions or of the Privacy Protection Policy, the User must renounce the use of the TOODDOC Website or Application.
By using the Website and/or the Application, the User also consents to the processing of his/her personal data, in accordance with TOODDOC's Privacy Protection Policy available at https://tooddoc.com/en/privacy-policy.

Article 2. Modification of the General Conditions of Use
TOODDOC has the right to amend, at its discretion, any part of the Website or the Application (as well as any information they may provide) or its General Terms of Service.
In case of amendment of the General Terms of Service, the new version will be posted on the following address https://tooddoc.com/en/terms-of-use and a notification via a banner on the Website and/or an email will be brought to the User's attention. The date shown at the top of this web page will indicate the latest update of the General Terms of Service.
By using the Website or the Application, the User accepts to be bound by the present Conditions as amended. If s/he does not agree with the amended Conditions, s/he must not continue to use those tools after the date on which the changes take effect.
Article 3. Services offered by the Website and the Application
TOODDOC connects doctors (general practitioner, dermatologist, ophthalmologist, etc.) with patients wishing to obtain a medical consultation. In this way, patients can have access to the practitioner's availability, choose the time slot that best suits them and obtain a medical appointment as quickly as possible from their smartphone or computer.
In the event of unavailability, TOODDOC notifies the physicians of the region and of the selected practice. In the event of the availability of a new time slot, it provides personalized alerts to patients who have requested it.
TOODDOC does not provide any medical advice. The service is limited to providing a connection between the patients and the participating practitioners, and to the alert service.
The User is informed that TOODDOC has no obligation to interfere in case of medical emergency. In such a case, TOODDOC advises the User to call the local emergency services.
Article 4. Advertising
The TOODDOC Website and the Application may contain commercial advertising. Advertisements may appear continuously or occasionally. TOODDOC may publish advertisements relating to the services offered but most of the time they will come from third parties.
TOODDOC cannot guarantee the reliability and accuracy of advertisements from third parties. TOODDOC is not bound by any form of liability arising from the contractual relationship or in connection with the General Terms of Service of third party advertisements published on the TOODDOC Website or Application.
When the advertisements contain links to services or applications from third parties, TOODDOC is not bound by any form of responsibility arising from the contractual relationship or in connection with the content of such services or applications or any information provided by them. TOODDOC is not responsible for any direct or indirect damage arising from the use of or in connection with the content or the goods or services to which the User has accessed via advertisements or other links on TOODDOC’s Application and Website.
Article 5. Unilateral right to prohibit the access
TOODDOC reserves the unilateral right to exclude and prohibit access to any natural or legal person who:
- would contravene the General Terms of Service of the Website and/or Application;
- would use the Website and/or Application in a malicious manner;
- would place false announcements on the Website or Application;
- would be detrimental to the good reputation of the Website or Application;
- would infringe on the intellectual property rights of third parties;
- would violate medical confidentiality.
TOODDOC reserves the right to prohibit and block the access to the contents of its Website or Application to Users employing one or more software programs designed to prevent the display of advertising on said Website.
Article 6. Focus group and objectives of this Website and Application
The Website and the TOODDOC Application, their content, the results of automatic processing, the data and the information available to the User are exclusively intended for the personal and non-commercial use of individuals who have respectively their usual residence or their registered office in Belgium.
The information, data or results of the automatic processing can not replace the personal judgement of the User. They can not be considered as medical advice or other medical diagnosis. This also applies to hyperlinks towards sites or applications that are not under the control of TOODDOC or its employees. To obtain a medical diagnosis adapted to his/her situation, the User must always make sure to refer to a practitioner who is a member of the Conseil National de l’Ordre des Médecins.
Article 7. Cookies
When the User consults the present Website, TOODDOC sends "cookies" to his/her computer under certain circumstances and in an automated process. The “cookies” are small applications that are stored on the User’s hard disk. These applications are mainly intended to facilitate his/her use of the site. In particular, they record the choice of language during the User’s first visit to the site. On his/her next visit the User will then automatically obtain the language chosen on his/her first visit.
Article 8. Navigation on the Website and the Application
TOODDOC, the Website (tooddoc.com) and Application (tooddoc android, IOS, web) and all documents and information available on the Website and Application are provided "as is" and "as available". TOODDOC does not warrant the accuracy, reliability, suitability, timeliness, completeness, performance or fitness for a particular purpose of the Website and/or Application or of any documents and information available on TOODDOC’s Website and Application.
The previous section also concerns the scheduling of appointments: for instance, TOODDOC cannot be held responsible if the appointment is not correctly transmitted to the practitioner.
TOODDOC ensures to provide a quality service to its Users and to resolve as quickly as possible any system failure that may occur. Whenever possible, TOODDOC will inform its Users in advance of any availability restrictions due to maintenance activities.
Article 9. Liability
The User is responsible of ensuring the adequacy of the Website and the Application to achieve his/her objectives. No liability is accepted by or on behalf of TOODDOC for any mistakes, omissions, or any other inaccurate documents or information on the Website and Application. In addition, TOODDOC does not warrant that the Website and/or the Application or any other document or information will be uninterrupted or free of mistakes or that all deficiencies will be rectified.
The User also acknowledges and accepts that the proper functioning of the Website and the Application depends on the correct and efficient functioning of the Internet, equipment and services of third parties. Therefore, TOODDOC does not warrant the proper functioning and cannot be held liable in case of failure to do so.

Practitioners using TOODDOC take the entire liability for managing their agenda.

This includes hacking or other malicious acts, arising out of or in connection with the use of this Website or the Application.

The websites or web pages to which this Website and the Application are linked are for information purposes only and have not been reviewed by TOODDOC. TOODDOC is not responsible for the content of these Websites or web pages. It also disclaims any liability for any losses or penalties arising from the use of any links or reliance on the content of any external websites to which the Website and Application are linked. TOODDOC is not responsible for the content of any external websites that link to or are contained within this Website.
The User cannot insert the Website or Application in a frame, create a link or deep link from this Website or Application to another website without the prior and written consent of TOODDOC. If the User wishes to frame or set up a link / deep link to TOODDOC's Website and/or Application, the User must contact TOODDOC at the following address: email@example.com.
All of this applies with the exception of sites related to medical practice and the health care sector.
If the User shares the Website or Application via social networks or third party sites and applications, the User must respect the rules of these third parties (in particular concerning privacy). Article 11. Computer viruses, worms and Trojan horses
TOODDOC uses reasonable efforts to protect this Website or its Application from computer viruses, worms and Trojan horses. TOODDOC does not warrant that the Website or its Application are free of computer viruses, worms and Trojan horses and disclaims all liability for any damage that may result from the transmission of computer viruses, worms or Trojan horses via the Website and Application or via files downloaded from the Website or Application. Article 14. Severability clause
If these General Terms of Service or any part of them should be held to be illegal, invalid or otherwise unenforceable, only the illegal, invalid or unenforceable part of these terms will be deleted. The rest of the General Terms of Service will remain unchanged and in full force and effect. The valid parts of the General Terms of Service shall continue to be binding and enforceable.
Article 15. Incidents beyond our control
TOODDOC will not be liable for any breach of these General Terms of Service caused by circumstances falling reasonably outside its control.
Article 16. Downloaded files
If certain Information files can be downloaded from the Website or Application, they shall be subject to these General Terms of Service and in particular to the "Intellectual Property Rights" section.
Article 17. Governing law and place of jurisdiction
Belgian law shall apply to any dispute, controversy, or complaint arising out of and/or in connection with these General Terms of Service, including any question relating to their validity, interpretation or execution.
In the event of a dispute, the Parties undertake to attempt an amicable resolution before referring the matter to a judge.
Where no amicable resolution can be found within sixty (60) workdays from the notification of the dispute, the controversy or the complaint, only the jurisdictions of the judicial district of Brussels/Brabant Wallon shall be competent to hear the dispute.
